Under the Consumer Contracts Regulations 2013, you have right to cancel this contract during a period of 14 calendar days from the date of this notice is sent or given to you. During that period, if you choose to cancel this contract, any money paid by you will be refunded, unless items that are made to measure or are custom made that are unable to be returned. However, if you already given written approval for the work to begin before then end of the cancellation period or you have contacted us within a matter of urgency and require that work is started as soon as possible, you may be required to pay for goods/ services already provided

If you wish to cancel the contract, you must do so in a written format i.e. electronic mail or by post or deliver personally to the person(s) named below. You may use the form below, but do not have to. Please make sure all writings are clear and concise and easy to read

Please note that the company is not liable for late delivery or missing letters and may require further assistance with the courier

The notice of cancellation is deemed to be served as soon as it’s posted (please date your cancellation) or in the case of electronic communication from the day it is sent

Request to Start Work

If you wish for the work to start before the end of the cancellation period, then you must put this request in writing, together with your acceptance that if the contract is fully preformed during this period and prior to any cancellation, then you lose your right to cancel

This request is to be made via letter, email or any other durable medium (i.e. allows the information to be addressed personally to the trader and enables them to store the information and access this in the future) and can be served personally, sent via email or by post to Element Gas LTD via the contact information above

If you have contacted us and asked us call and undergo urgent repairs or maintenance to your property/ contents, you have no right to cancel this contract and the information below does not apply to the contract



If you have contacted us in regards to cancelling goods that we will supply have been made to your specification (i.e. custom made), then you have no right to cancel the contract and the information below does not apply to this contract


Your Right to Cancel the Contract

You have a right to cancel without giving any reason, (does not include those listed above). The cancellation period starts when we enter into the contract with you and will end 14 calendar days after you have taken possession of goods and/or services we are supplying to you

In order to exercise your right to cancel, you must inform us of your decision by a clear statement, by letter or by email. You may use the attached form, but do not have to

To meet the cancellation deadline, you should let us know that you wish to cancel before the cancellation period has expired. If you want to put this in writing, please send to the address given above


Effects of Cancellation

If you cancel this contract we will reimburse you all that you have paid us, subject to certain possible deductions set out below. However, once we have delivered the goods, you may wish for us to start work straight away and to do this, we will need a specific request from you because of the cancellation period. This will mean you still have the right to cancel, but:

  •   You will have to pay a proportional cost, which may include labour and any services we have carried out up to the point that you have informed us of your decision to cancel

  •   We will not collect or remove any goods that we have installed, unless we have offered to do so. However, if the goods have not been installed and cannot be sent back to us by post, we will make arrangements to collect them. We are not liable for any loss or damage occurred during transit by third party

  •   You may remove the goods yourself and return them to us at the above address and at your own expense within 14 calendar days of informing us of your decision to cancel, unless this was offered by us

  •   We may reduce any reimbursement to take account of loss in value of goods caused by any handling by you

We will

make the reimbursement without any delay and not later than:

a)  14 calendar days after the day that we have received your goods that we supplied back from you in reusable order. (Please note that we cannot accept damage or loss to goods and may incur a deduction from your reimbursement), or

b)  (If earlier), 14 calendar days after the day you provide evidence that you have returned the goods, or

c)  If there were no goods supplied or if there were goods and we offered to collect them, 14 calendar days after the day on which we are informed of your decision to cancel the contract


We will
transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement

make the reimbursement using the same means of payment as you have used for the initial


We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent goods back, whichever is earliest
